Attacker avoids jail over Oliver Place assault

A man who was found guilty of assaulting a woman to her severe injury has escaped a prison sentence.

Daniel David Finnegan, 25, of Ramsay Road, was convicted of assaulting the victim by seizing hold of her hair, pulling her to the ground whereby she fell on her arm to her severe injury.

The assault took place in Oliver Place on September 10 last year.

Defence lawyer Rory Bannerman told Jedburgh Sheriff Court: “He has taken full responsibility for his actions.”

He pointed out his client had shown empathy for his victim and had a problem with alcohol.

Sheriff Ian Anderson said it had been an unpleasant experience for the victim and imposed a community payback order involving 200 hours of unpaid work over a six-month period.
