A man who struck a male over the head with a bottle escaped a prison sentence at Selkirk Sheriff Court on Tuesday.
Sheriff Janyss Scott told Gary Turnbull that after reading background reports and her notes on the case she had every intention of jailing him.
But after an impassioned plea from defence lawyer Iain Burke – who explained the 27-year-old would lose his job and that the assault was carried out under provocation – she decided to impose the alternative to custody.
Turnbull, of Allars Crescent, was ordered to carry out 200 hours of unpaid work in the community and was put on probation for two years.
He pleaded guilty to assaulting Darren Gullen in Howegate, on April 23, by striking him on the head with a bottle and punching him on the head and body all to his injury and permanent disfigurement.
