Offender back behind bars

A REPEAT offender who committed a breach of the peace just two weeks after being released from prison, and while on an ASBO, was sent back behind bars for 140 days.
At Jedburgh Sheriff Court last Thursday, Andrew Atkinson, was thereafter ordered to serve one month of an unexpired jail term.

The 20-year-old, of Wellfield Road, appeared from custody and admitted kicking the door of a house in Branxholme Road, o
n March 7, and challenging the occupants to fight.

When Atkinson began banging and kicking their front door shortly after midnight, the householders told him to go away, but the accused threatened, "I'll kick your head in and smash all your windows."

Depute fiscal Juliet Petrusev told how Atkinson had turned up at the address around 11.15pm, believing his ex-girlfriend was there.

"Although he was allowed into the property, he was asked to leave as he started to become quite abusive," she explained. Atkinson returned shortly after midnight and began banging and kicking the front door.

"He wasn't allowed in and began shouting and swearing, and challenged a male to come outside and fight."

Police attended and found the accused nearby.

Defence solicitor Rory Bannerman conceded the fact his client was not long out of prison and subject to an Antisocial Behaviour Order aggravated matters.

Sheriff Kevin Drummond described Atkinson's criminal record as "horrendous.

"You have a formidable record for a young man," he told him.
