Breach of peace man fined

A 20-year-old first offender who made a homophobic remark to a man in the street, was fined £75.
Asked why he had referred to the man as a "poof", Sean McGregor candidly replied it was the first thing to come into his head.

McGregor, of Hamilton Road, admitted committing a breach of the peace on the High Street on June 7.

Depute fiscal Sally Clark said the offence happened in the early hours of Common-Riding Saturday.

She said the accused and a friend were walking along the High Street, when they became aware of two others walking towards them, and an argument developed.

"He began shouting and swearing, and called the male a poof," explained Ms Clark.

Defence lawyer Colin McNab commented: "Given the date, he wasn't the only one singing and swearing, but it was the use of this one politically incorrect word which sees him here today.

"When police asked him why he had called him that name, he said it was the first thing which came into his head," added Mr McNab.
